Che cos’è il digital kidnapping (e come lo sharenting può favorirlo)

In virtù del sostegno della tutela del diritto alla privacy del minore, ha sentito la necessità di confrontarsi con la giurisprudenza per mettersi in guardia, anche come madre, di fronte al mondo dei cybercrime, nell’ ottica di una generazione di nativi digitali che utilizzano smartphone, tablet e smartwatch sempre e ovunque. Sta approfondendo, tra gli altri, il tema del digital kidnapping. Abbiamo fatto quattro chiacchiere con lei per approfondire.

Che cosa si intende per digital kidnapping?

Il digital kidnapping, letteralmente “rapimento digitale”, è uno dei cybercrime più recenti ed attuali e rientra nel reato di sostituzione di persona online (ex art. 494 del nostro Codice Penale). Si configura quando un qualsiasi utente del cyberspazio salva materiale fotografico di un minore i cui genitori sono completamente ignari, riutilizzando le immagini rubate per creare una nuova identità, con dati anagrafici, stati e svariate informazioni completamente fittizie e inserendo quindi la vittima in un nuovo contesto, donandole una nuova vita virtuale tramite falsi profili, giochi di ruolo o inserendoli nella propria vita privata: tale condotta ingannevole e lesiva nei confronti della comunità di utenti  viene messa in atto sovente per conseguire un vantaggio economico (ad es. il mercato pedopornografico), vantaggi non patrimoniali (ad es. per avere più “like” sul proprio social network)  oppure per infliggere un danno altrui ( scherno, diffamazione) . Si tratta di una pratica piuttosto inquietante e macchinosa che si nutre dei contenuti visivi immessi in rete. 

Come lo sharenting può favorire il “rapimento digitale”?

Se il digital kidnapping ha come punto cruciale l’appropriazione indebita di immagini di minori pubblicate in Internet, lo definirei  propriamente il “figlio illegittimo” dello sharenting. Molti genitori, per soddisfare la propria velleità narcisistica, condividono materiale fotografico dei propri figli tramite device tecnologici sempre più performanti e a portata di clic, ignorando quanto sia rischioso esporli nel mare di internet: è possibile che dietro all’ identità di un utente di dubbia affidabilità, che non si è mai visto né conosciuto di persona, si possa nascondere un cybercriminale. Ebbene lo sharenting costituisce in qualche modo un atto di “favoreggiamento” di un possibile reato la cui vittima diretta è un minore innocente. 

Può citare alcuni casi?

I primi casi di Digital Kidnapping risalgono ai primi anni dopo il 2010 , ovvero qualche anno dopo il boom dei primi social network, sviluppandosi particolarmente negli USA. Un primo episodio del 2011 riguarda una madre di Brooklyn, Julia Fierro , la quale scoprì che una foto pubblicata sul suo profilo Facebook, che ritraeva sua figlia di due anni in altalena con una particolare espressione: era stata  trasformata in un meme poi pubblicato sul social network Reddit, diventando virale in tutto il web. L’artefice di tutto questo era stato un collega del marito che, in buona fede, aveva  ritenuto innocua la creazione di un meme spiritoso, senza affatto considerare l’uso dell’immagine di minore contro la volontà dei genitori e della ingovernabilità del contenuto una volta in rete (questo meme continua tutt’oggi  inesorabilmente ad apparire su diversi siti).
Nel 2015 una madre del Texas, Danica Patterson, fu avvertita da uno dei suoi contatti, che le inviò un print screen di una bacheca di Facebook appartenente a un uomo di New York, su cui erano pubblicate foto di sua figlia di quattro anni di cui l’uomo si fingeva il padre. La madre volle affrontare la questione giuridicamente, ma Facebook rispose che il profilo del “falso padre di sua figlia” non stava violando il regolamento della community, in  quanto in Texas il furto di identità del minore da parte di qualcuno che si finge un parente non costituisce alcun reato. Agli inizi del 2021 Sabrina, mamma blogger e influencer del milanese con ben 18mila follower, ha denunciato  all’autorità l’esistenza di un suo profilo Instagram clonato, che vantava gli stessi contenuti, fatta eccezione per un particolare: le foto che ritraevano la bambina in costume da bagno durante le vacanze erano state tagliate e mostravano solo le parti intime, Sebbene la giovane mamma aveva fin da subito già individuato il titolare di tale condotta, il quale si era scusato promettendo la rimozione del profilo clonato, ha preferito  procedere con la denuncia dell’accaduto, riportando i fatti sul suo stesso profilo online come avvertimento per le altre mamme follower.
